The second conference in the framework of the INNOCENT international project

On 8 February 2024, the second conference in the framework of the international project INNOCENT – Improving the application of the presumption of INNOCENce while applying elecTronic evidence (GA No. 101056685) took place in Bratislava, Slovakia.

Lecturers included renowned experts from the Council of Europe, the European Parliament, and law schools from the EU. The event was attended by over 20 prosecutors, lawyers, judges, and other court professionals.

The conference focused on the new EU legislation on electronic evidence and innovations, as well as new developments related to the Convention on Cybercrime. Professor Anže Erbežnik, PhD, a member of the research group of the Science and Research Centre Koper, presented the Regulation on European Production and Preservation Orders for Electronic Evidence in Criminal Matters. Together with Judge Martin Jančar, MSc, they also presented the first draft of the Manual on Digital Evidence, written by Professor Benjamin Flander, PhD, in cooperation with Professor Anže Erbežnik, PhD.

The event was concluded with panel discussions held in line with the World Café method. The invitees were given the opportunity to answer sets of questions about the legal framework for the management of electronic evidence, the selection and importance of court experts, the European Production and Preservation Orders for electronic evidence, and the balance between efficiency and the protection of the presumption of innocence and other rights and guarantees. The participants of the event once again noted a marked confrontation between the two imperatives of the criminal process, i.e. the efficiency of criminal prosecution and ensuring a safe society on the one hand, and the fairness of a criminal law procedure on the other hand.

A handbook which will first and foremost be intended for judges, lawyers and prosecutors who are increasingly faced with dilemmas related to electronic evidence will be issued in the framework of the project.
